What Ocean County Divorce Records Show

A divorce record in Ocean County contains every document filed with the court during the case. The complaint starts the file. It names both spouses, states the grounds for divorce under N.J.S.A. 2A:34-2, and lays out what the filing spouse wants. The most common ground is irreconcilable differences. Other grounds include desertion, extreme cruelty, and separation for 18 months or more.

Beyond the complaint, the file may include an answer, counterclaim, motions, court orders, financial statements, and a marital settlement agreement. The final judgment of divorce is the last major document. It dissolves the marriage and sets the terms for property, custody, support, and other issues. This judgment is what most people seek when they request Ocean County divorce records. Certified copies of the judgment carry the court seal and are accepted for legal purposes.

Under N.J.S.A. 2A:34-10, the court must verify that it has proper jurisdiction before entering the judgment. At least one spouse must have been a New Jersey resident for 12 months before filing on no-fault grounds. The judgment then becomes a permanent part of the court record in Ocean County.

Public Access to Divorce Records

Ocean County divorce records are public under N.J.S.A. 47:1A-1. You do not need to be one of the spouses. Anyone can ask to see a divorce record at the courthouse in Toms River.

Court Rule 1:38 sets the rules for what parts of a court file are open to the public. Most of the divorce record is accessible. Financial disclosure statements and documents related to children are sometimes sealed or have portions blacked out. The court makes these decisions on individual cases. The basic facts of the divorce, including names, dates, grounds, and the judgment terms, are almost always available in Ocean County divorce records.

You can file a formal request through OPRA if you prefer a written process. Put the request in writing and include the names, dates, and docket number if possible. The Superior Court Clerk's Office handles copy requests and can tell you the current fees. The court has seven business days to respond to an OPRA request.

Ocean County Divorce Certificates

A divorce certificate is not the same thing as a divorce record. The certificate is a short form that proves a divorce happened. It lists the names, date, and county. It does not include the settlement terms or court orders. The New Jersey Department of Health issues these through its Office of Vital Statistics.

To get a divorce certificate, write to the Office of Vital Statistics at P.O. Box 370, Trenton, NJ 08625-0370. The cost is $25 for one certified copy. Extra copies ordered at the same time are $2 each. You can also visit their office at 140 East Front Street in Trenton. Certificates go back to 1848 for all New Jersey counties, including Ocean County. If you need the full judgment with property and custody terms, request that from the Ocean County Superior Court instead.
