New Jersey Law and Divorce Records Access
Most divorce records in New Jersey are open to the public. Under N.J.S.A. 47:1A-1, the state's public records law grants broad access to government documents, including court files. Anyone can request a copy of a Mercer County divorce record. You do not need to be a party to the case to obtain basic documents from the file.
Court Rule 1:38 provides the framework for public access to court records statewide. It defines which documents are open and which are restricted. In Mercer County divorce cases, the final judgment is almost always public. Other parts of the file may be sealed. Financial disclosure forms, child custody reports, and documents involving minors often have restricted access. A judge may also seal specific filings by court order in any given case.
Divorce in New Jersey falls under N.J.S.A. 2A:34-2, which sets out the grounds for divorce. Irreconcilable differences is the most common ground used in Mercer County and across the state. Under N.J.S.A. 2A:34-10, the court clerk must report each divorce to the state registrar. This reporting requirement is how the Department of Health builds its database of divorce certificates. The New Jersey Courts self-help page has forms and step-by-step guides for the divorce process.

The New Jersey State Archives in Trenton may also have older Mercer County divorce records. Because Trenton is the state capital, many state-level record repositories are physically close to the Mercer County courthouse. This can be convenient if you need to visit both the court and the state archives in one trip.
Keep in mind that online tools show basic data. They list names, dates, and case status. They do not provide full copies of divorce decrees or settlement agreements. For complete documents, you must contact the court or visit in person. Online searches are a strong starting point for any Mercer County divorce records lookup.
Note: Not all Mercer County divorce records appear in online databases. Older cases filed before digital record keeping may only be available through the Records Information Center.
Divorce Certificates from the State
A divorce record from the court and a divorce certificate from the state are two different documents. The Mercer County court file contains the full case. This includes the complaint, the answer, the property settlement, and the final judgment. A divorce certificate is a one-page form from the New Jersey Department of Health. It confirms a divorce happened but does not include the terms or details.
Which document you need depends on who asks for it. A lender may want the full judgment. A state agency might accept the short certificate. Ask the requesting party before you order. This saves time and avoids paying for a document you do not need. Because Trenton is the state capital, the Department of Health offices are in the same city as the Mercer County courthouse. This can make it easier for Mercer County residents to get both documents if needed.
